Model Booking Terms & Conditions

Introduction & Applicability

These Terms & Conditions (“Terms”) apply to every model booking made through The Fashion Bureau (“the Agency”). They operate in accordance with the Employment Agency Regulations 1973.

A booking is confirmed when the Agency issues a Booking Confirmation Form. By signing the Booking Confirmation Form — or by proceeding with the booking after receiving it — the client accepts these Terms in full.

No amendment to a Booking Confirmation Form is valid unless expressly agreed and re-signed by the Agency. If any inconsistency exists between these Terms and the Booking Confirmation Form, these Terms prevail.

Standard Booking Process

The client submits a booking request or brief to the Agency.
Agency bookers provide suitable model options.
A casting may take place — either in person, online, or via self-tape.
Once a model is selected, the Agency issues a Booking Confirmation Form detailing fees, usage rights, timings, and any special terms.
The client must read and confirm the Booking Confirmation Form. Any requested
changes must be agreed before the booking takes place.
Any alterations, cancellations, or extensions must follow the rules set out in these Terms.

Working Hours & Overtime

Standard Day: 8 hours between 9am–6pm, including a 1-hour lunch break.
Half Day: 4 hours between 9am–6pm.

Standard overtime rates:

5–30 minutes beyond confirmed finish time: 50% of hourly rate.
30–60 minutes: 100% of hourly rate (charged as a full hour).
Before 9am or after 6pm: 150% of hourly rate.

Weekend / Holiday rates:
Saturday: 150% of hourly rate.
Sunday & UK Bank Holidays: 200% of hourly rate.

Travel & Expenses

Travel time beyond a 5-mile radius of Hyde Park Corner is charged at 50% of the hourly rate, unless agreed otherwise in writing.
Any bookings that require an over night stay will be charged at 200% of the hourly rate or at a pre agreed rate before confirmation.
All expenses incurred on the client’s behalf will be recharged with a 12.5% administrative uplift

Location Bookings

A location booking is any job taking place outside a standard studio or workplace.

Client responsibilities:

Safe and appropriate travel arrangements must be agreed before the booking is confirmed.
If the client does not provide transport, the Agency will arrange transport and recharge the cost with a 12.5% uplift.
If the model is unable to return to London for other work, 50% of the day rate will be charged for each day they remain unable to work.
Clients must conduct a risk assessment and notify the Agency of any health & safety concerns. Model welfare must always remain a priority.

Castings

Castings are unpaid unless they exceed 15 minutes.
If a casting lasts more than 15 minutes, a £50 standard casting fee applies.

Use of Images & Usage Rights

Usage rights must be clearly agreed and set out in the Booking Confirmation Form.

Any additional usage — including extended duration, additional media, increased territories,social media, online advertising, behind-the-scenes use, artwork, or adaptations — requires prior written agreement and will incur additional fees.

It is the client’s responsibility to notify the Agency if further usage is required.

Territories

Additional fees apply for usage rights outside the United Kingdom unless otherwise agreed.

Test Photography

Test photography is strictly non-commercial. Commercial use requires written Agency approval prior to shooting.

Copyright

Photographers and clients may only use images for the rights purchased. Any additional use requires written approval.

The Agency and the model may use images from the booking solely to promote the model’s career.

Nudity & Sensitive Content

Any nudity or partial nudity must be pre-agreed and included in the shoot brief.
The model may refuse any content they consider inappropriate.
The client must ensure a safe and respectful environment at all times.

Agency Fees

Agency fees operate on a flexible sliding scale of 15%–33.33%, determined by job type, usage, model rate, and client budget. Fees are confirmed in the Booking Confirmation Form.
Both Agency and model fees will be invoiced by the Agency.

VAT

The Fashion Bureau is VAT registered. Unless otherwise agreed (e.g., where the client is VAT-exempt), VAT will be applied to all fees and expenses.

Invoicing & Payment Terms

Payment is due within 30 days of invoice date.
The individual or business making the booking is the responsible party unless agreed otherwise in writing.
The Agency may invoice the ultimate client, in which case both booking client and ultimate client are jointly and severally liable.

Late Payments:

Interest is charged at 5% per annum above Barclays Bank base rate, accrued daily.
The Agency may apply statutory late-payment charges (£40–£100) under the Late Payment of Commercial Debts Act 1998.

No usage is permitted until all related invoices are paid in full.

Exclusion / Exclusivity Fees

Models are supplied on a non-exclusive basis unless otherwise agreed.
Exclusivity or category restrictions require a separately negotiated fee.
Clients are responsible for checking whether the model has any conflicting existing work.

Cancellation by the Client

All cancellation periods are calculated in working hours only, defined as 09:00–18:00 (UK time), Monday to Friday, excluding UK bank holidays.
Within 24 working hours of call time: 100% of the booking fee payable.
Between 24–48 working hours of call time: 50% of the booking fee payable.
Reduction of hours within 48 working hours of call time: Full booking fee applies.
Monday bookings: Must be cancelled by 09:00 on the preceding Thursday (excluding bank holidays).
For bookings longer than 3 days: cancellation period must equal or exceed the length of the booking.

Cancellation by the Agency

The Agency will use reasonable endeavours to provide notice, offer alternatives, and mitigate disruption.
The Agency may cancel a booking at any time prior to the booking date without liability.
Clients are responsible for maintaining appropriate insurance.

Mixed Agency Bookings

If other agencies’ models are booked at higher rates, the Agency may adjust its rates accordingly.

Liability & Insurance

The Agency’s total liability is limited to the total fees paid or payable for the booking.

The Agency is not liable for loss of profits, business interruption, reputational damage, or failure of a model to attend.

Clients must maintain adequate insurance, including cancellation and travel insurance.

Contracting & Authority

All negotiations relating to model services and image usage must be conducted with the Agency only. Any direct agreements made with models are not valid unless confirmed in writing by the Agency.

Non-Solicitation & Protection Period

For 12 months after:

a model has been introduced,
casted,
or booked through the Agency,

the client may not book that model (directly, via another agency, or independently) without the Agency’s written consent.
If breached, the Agency may seek full loss of earnings, including fees payable by the client and any agency involved.

Complaints

Any concerns must be reported immediately. Complaints raised after delivery of services may not be actionable.

Force Majeure

The Agency is not liable for delays or failures caused by events outside its control.

Interpretation

These Terms override any conflicting client terms. The Booking Confirmation Form forms part of these Terms.

General

Invalid provisions are severed without affecting the remainder.
Rights and obligations survive termination where appropriate.
These Terms are confidential.
Amendments must be in writing and signed by both parties.
Governed exclusively by English law and the courts of England and Wales.
